Abstract

The COVID-19 pandemic is an opportunity for members who do not have good faith to default in the form of negligence in running a business in a mudharabah contract. In other words, this pandemic can be used as a cover for the negligence of members. This study aims to evaluate every case of failure to return capital by members of recipients of financing facilities at KSPPS BTM BiMU, whether due to the impact of the pandemic/force majeure condition or due to poor performance/default. The next step is to find out whether there are implications of the case for changes in the contents of the contract in the mudharabah contract that was agreed upon at the beginning of the financing application at KSPPS BTM BiMU. This study uses qualitative methods with the type of empirical normative research. It is said to be normative research because this research uses fatwa and applicable laws as sources of legal research material. while it can be said as empirical research because this research takes its legal material by means of observations to related institutions, namely KSPPS BTM BiMU and direct interviews with related parties.
