PEMBAHARUAN HUKUM ISLAM DAN LAPANGAN IJTIHAD
Abstract
Hukum Islam telah diprogram oleh Allah Swt untuk selalu tampil di suatu masa, di mana kemajuan dalam kehidupan manusia sampai pada tataran puncak. Pada taraf itulah tentunya akan banyak masalah baru yang muncul yang akan dihadapi oleh umat manusia dan bisa terjadi di mana hukumnya tidak atau belum diketemukan baik di dalam al-Qur‟an mauun di dalam asSunnah (hadis Nabi), atau bahkan bisa saja terjadi dimana hukumnya belum pernah dibahas oleh para fuqaha‟ yang terdahulu. Di dalam kajian filsafat hukum Islam dimana ada prinsip bahwa didalam kehidupan umat Islam tidak diperbolehkannya terjadi suatu kekosongan hukum. Sangat tidak diperkenankan dalam kehidupan ini ada suatu masalah baru yang muncul, namun kemudian tidak diketahui hukumnya. Untuk itulah, Islam membuka pintu ijtihad seluas-luasnya.References
