PROBLEMATIKA UANG HARAM DALAM KAJIAN FIQH
Abstract
Pada dasarnya uang adalah alat untuk pembayaran suatu barang terkait kebutuhan yang diminiati, namun akan menjadi salah dalam realisasinya pada nilai kandungan hukumnya. Uang akan menjadi alat tidak hanya sekedar transaksi jual beli, namun uang juga menjadi alat ambisius seseorang dalam segala kepentingan yang dituju. Oleh karena itu uang harus diberikan tuntunan yang syar‟i sesuai hukum Islam, tentunya dengan perspektif ushul fiqh. Tuntunan dalam Islam bukan menghukumi uang dalam label halal ataupun haram, namun lebih menekankan pada pengguna uang tersebut. Dalam kondisi ekonomi sulit bahkan ekonomi yang semapan apapun dari zaman kezaman harus ada regulasi terkait dengan ketentuan hukum terkait uang.
Konsep ushul fiqh telah dijelaskan untuk senantiasa menjaga harta/uang (hifdzul mal), dalam menjaga atau melindungi harta/uang sedari dulu, setiap orang menjaga harta/uang dengan cara-cara manual dan klasik, namun pada saat zaman modern sekarang menjaga harta/uang tentunya melalui perantara Bank, baik Bank Konvensional maupun Bank Syariah. Untuk itulah apapun dan bagaimanapun sulit serta mudahnya menggunakan harta/uang maka perlu ada cara-cara baik, santun adil serta bermanfaat untuk kemaslahatan umat.
Dalam menghadapi masalah-masalah hal ini, Islam memandang fenomena uang haram terkait kegunaan dan fungsi harus berimplikasi pada ajaran-ajaran agama. Artikel ini akan menganalisis bagaimana ungkapan "uang haram" dalam arti majazi, apakah uang haram itu dilihat dari sudut diperoleh lewat jalan haram atau uang yang haram tersebut harus di-tasarruf-kan.
